India has recently implemented new regulations to regulate the country's online gaming industry. The new rules aim to safeguard Indian gamers and their funds against online scams and frauds, encourage responsible gaming, and protect young and vulnerable users against online abuse and indecency. These regulations come after a long journey of discussions and debates, marking an important milestone for the Indian online gaming industry. Background

Online gaming has been gaining popularity in India for the past few years. The industry has seen significant growth, with the COVID-19 pandemic further accelerating the trend. As a result, the Indian government has been closely monitoring the industry to ensure that it is regulated, and players are protected.

New Regulations

The Ministry of Electronics and IT (MeitY) has announced new regulations to protect online gamers from harmful content and addiction. These regulations come in the form of an amendment to the existing Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. The amendment rules classify a provider of online games as an "intermediary" under the Information Technology Act, 2000 (the "IT Act"), thereby creating a separate classification called "Online Gaming Intermediary." 

The new rules prohibit any game that involves betting and wagering, and permissibility will be determined with the simple principle of whether wagering is involved. Additionally, a self-regulation model has been applied for the online gaming sector where SROs will approve the games that can operate in the country in accordance with the rules.

Proposed Regulations

An inter-ministerial task force set up by the Ministry of Electronics and Information Technology (MeitY) has proposed the creation of a central regulatory body for the sector, clearly defining what games of skill and chance are, and bringing online gaming under the purview of the Prevention of Money Laundering Act. India should also create a regulatory body to classify online games based on skill or chance, introduce rules to block prohibited formats, and take a stricter stance on advertising and celebrity endorsements.

Impacts and Implications

The booming online gaming industry in India has great potential for growth and job creation, with estimates of up to 40,000 new job opportunities by 2023. The market size for online games is expected to grow from US$543 million in 2021 to US$2 billion by 2023. However, with this growth comes the need to ensure the protection of Indian gamers and their funds against online scams and frauds. The industry needs to encourage responsible gaming, particularly given the potential negative health effects of excessive gaming. Additionally, it is essential to protect young and vulnerable users against online abuse and indecency.

Indian gaming has already demonstrated its ability to generate a continuous revenue stream with direct, positive economic and social impacts on Native American communities. However, our understanding of the impacts of Indian gaming on Indian countries remains far from complete. The online gaming segment in India was estimated at INR 136 billion in FY21 and is projected to grow at a Compound Annual Growth Rate (CAGR) of 21% over FY21-FY25. 

Online casual gaming emerged as a major channel with a game base of 420 million users in FY21 and a revenue contribution of INR 60 billion.

The Indian government has taken steps to address these concerns, including drafting legislation to regulate online gaming.
